This Shipping & Returns Policy governs orders processed through https://cmiqhealth.com or other authorized channels of CardioMetaboliQ Labs LLC dba CMiQHealth. It is incorporated into our Terms & Conditions by reference. The Services are sold exclusively to licensed healthcare practitioners.

1. Order Processing

Orders are typically processed within 23 business days of receipt. Processing times may be extended during peak periods or due to supply, regulatory, or quality-assurance requirements.

2. Shipping Methods

We ship via established common carriers. Shipping methods, available service levels, and estimated delivery dates are presented at checkout. Estimated delivery dates are estimates only and are not guaranteed.

3. Title and Risk of Loss

Title and risk of loss for products purchased by licensed practitioners pass to the practitioner upon delivery to the carrier (FOB Origin). Practitioners are responsible for arranging adequate receiving and storage at the destination address.

4. FTC 30-Day Rule

In compliance with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), if we are unable to ship your order within thirty (30) days of receipt (or any longer period clearly stated at the point of purchase), we will notify you and offer the choice of (a) accepting a revised, definite shipment date, or (b) cancelling the order with a full refund.

5. Address Accuracy and Delivery Issues

You are responsible for the accuracy of the shipping address you provide. We are not responsible for delays, additional charges, or losses caused by incorrect, incomplete, or undeliverable addresses, refused deliveries, or carrier service disruptions.

6. Inspection and Reporting of Issues

Inspect shipments promptly upon arrival. Report any damaged, defective, or incorrect items to support@cmiqhealth.com within seven (7) days of delivery. Include your order number, photographs of the items and packaging, and a description of the issue. Issues reported after this period may not be eligible for replacement or refund.

7. Return Eligibility

Returns are accepted only for items that are defective, damaged on arrival, or shipped in error. Used or opened test kits, used or opened supplements, and any items contaminated by biological material are not eligible for return under any circumstances, due to public-health and biohazard regulations.

8. Return Authorization Procedure

Contact us before returning any item to obtain a Return Merchandise Authorization (RMA) number. Returns received without a valid RMA may be refused. The RMA must be used within fourteen (14) days of issuance.

9. Used or Opened Test Kits Biohazard Notice

Used or partially used test kits, samples, and any item that has come into contact with biological material may not be returned through standard carriers and may not be returned to us under any circumstances. Such items are subject to U.S. Department of Transportation rules at 49 CFR §§ 173.134 and 173.196, OSHA Bloodborne Pathogens Standard at 29 CFR § 1910.1030, and applicable state biohazard rules. Any such item received in error will be destroyed at the sender's expense in accordance with applicable rules.

10. Return Shipping Costs

For approved returns of items that are defective, damaged on arrival, or shipped in error, we will provide a prepaid return shipping label. For all other returns, the practitioner is responsible for return shipping costs.

11. Refunds

Approved refunds are processed to the original payment method after we receive and inspect the returned item. Please allow seven to ten (710) business days for the refund to appear on your statement after processing.

12. Exchanges

Where inventory permits, we may, at our discretion, exchange a defective or damaged item for the same product or a functionally equivalent product.

13. Lost or Stolen Packages

We are not responsible for packages confirmed by the carrier as delivered. Practitioners must file a claim with the carrier; we will provide reasonable assistance with claim documentation.

14. Force Majeure

We are not liable for delays or failures in performance arising from circumstances beyond our reasonable control, including natural disasters, public-health emergencies, acts of government, labor disputes, supplier or carrier failures, or acts of war or terrorism.

15. Dispute Resolution

Any dispute relating to this Shipping & Returns Policy is subject to the dispute-resolution provisions of the Terms & Conditions, including the binding-arbitration and class-action-waiver provisions in Section 17 of the Terms.
